Significant Sentence Reduction in Assault Case

Background / Issue

The client, a foreign student in Korea, was involved in a physical altercation at a nightlife venue that resulted in injury to another patron. CCTV footage appeared damaging, and the prosecution initially sought a substantial prison sentence based on the severity of the injuries and the location of the incident.

Our Legal Approach

We conducted a frame-by-frame analysis of the surveillance footage and identified mitigating circumstances, including the client's attempts to withdraw from the confrontation and the role of third parties in escalating the situation. We gathered witness statements from individuals present, presented evidence of the client's otherwise clean record and academic standing, and engaged in sustained negotiation with the prosecution. We also facilitated a victim compensation agreement that reflected genuine remorse.

Result / Outcome

The prosecution revised its sentencing recommendation downward. The court imposed a suspended sentence with probation, avoiding actual imprisonment. The client was permitted to continue their studies under supervised conditions. The conviction was later eligible for record sealing, preserving the client's future immigration and employment prospects.
