Contract Breach Arbitration Win for International Distributor

August 2025

An international distributor was wrongfully terminated by a Korean manufacturer. We prevailed in arbitration, securing reinstatement of contractual rights and damages.

Background / Issue

Our client, an international distribution company, held an exclusive distribution agreement with a Korean manufacturer. After several years of successful cooperation, the manufacturer unilaterally terminated the agreement, claiming material breaches that the client disputed. The termination threatened the client's existing customer relationships, inventory investments, and market position in the territory.

Our Legal Approach

We reviewed the distribution agreement, performance records, and correspondence to establish that the client had fulfilled all material obligations. We identified procedural defects in the termination notice and demonstrated that the manufacturer's alleged grounds were pretextual. We prepared a comprehensive arbitration submission including financial analysis of lost profits, evidence of the client's performance history, and expert testimony on industry standards for distributor-manufacturer relationships.

Result / Outcome

The arbitration panel ruled in favor of the distributor, finding that the termination was wrongful and not supported by the contractual terms or the evidence presented. The award included reinstatement of the distribution rights for the remaining contract term, compensation for lost profits during the wrongful termination period, and reimbursement of legal costs. The client resumed their distribution operations and preserved their market position.
